חוק הנוטריונים קובע מספר תנאים לכשירותו של נוטריון:

עליו להיות אזרח ישראל,

חבר לשכת עורכי הדין,

שעסק בעריכת דין 10 שנים לפחות,

לא הורשע בעבירה שיש עמה קלון או הושעה מלשכת עורכי הדין,

ועבר השתלמות מיוחדת.

אדם אשר עומד בתנאים הללו יכול לבקש מוועדה מיוחדת שיושבת במשרד המשפטים רישיון להיות נוטריון.

הוועדה, שמתכנסת כפעמיים בשנה, בוחנת את המסמכים של המועמד, ואם היא סבורה שהוא ראוי, הוא נדרש לחתום בספר הנוטריונים ולהשאיר שם את דוגמת חתימתו. 

לאחר מכן הוא יכול להתחיל לכהן כנוטריון.

מכאן שלא כל עורך דין יכול להיות נוטריון אך נוטריון חייב להיות עורך דין.

 

 

:Notarial law in Israel stipulates certain conditions to notary's qualifications

He must be a citizen of Israel

A member of the Israel Bar Association

 A lawyer in practice for at least 10 years

No convicted turpitude or suspended from the Bar Association

A special training

A person who meets these conditions can request a Special Committee in the Ministry of Justice to be notary license. The Committee, meeting twice a year, examines the applicant's documents and if it believes he deserves, he is required to sign in the notary book and keep his name such as his signature. Then he can start as a notary
